LOL OUTDOOR CINEMA PACKAGE PROMOTION

Terms and Conditions of Entry

1. The Promoter is Golden Circle Limited (ABN 85 054 355 618) of 260 Earnshaw Road, Northgate, QLD 4014 (the Promoter).
2. Information on how to enter this Promotion forms part of the conditions of entry. Entry into this Promotion is deemed to be unconditional acceptance of these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
3. Employees of the Promoter and their immediate families and all companies and agencies associated with this Promotion and their immediate families are ineligible to enter. “Immediate family” means spouse, parent, child or sibling, whether or not they live in the same household with the employee.
4. Entry is open to all Australian residents (the Eligible Entrants). If the winner is under the age of 18 years, the entrant must have prior parental or legal guardian consent to enter. If the winner is under 18 years of age, the prize will be awarded on behalf of the winner to the winner’s parents or legal guardians.
5. The Promotion commences on Monday, 30 January 2012 at 12:01 a.m. Australian Eastern Standard Time (“AEST”) and concludes on Sunday, 8 April 2012 at 11:59 p.m. AEST (the Promotion Period).The Promotion is a game of chance.

How to enter

6. For a chance to win, Eligible Entrants must, during the Promotional Period:
(a) Purchase one, four pack (1 x 4) of specially marked 250ml cans of LOL carbonated fruit juice in any of the following flavours:

  • B CURRENT;
  • RAZZ BRI; or
  • TROPKL

from any store nationally in Australia;

  • (b) Visit www.drinklol.com.au  and
  • (c) Complete the online entry form, including full name, contact phone number, postal address, state, email address and the unique code which can be found on the inside of the 4-pack outer-wrapper.
  • (d) Eligible Entrants must retain the original copy of their receipt as proof of purchase.

Entry requirements

7. Entries not completed in accordance with these Terms and Conditions or received after the close of the Promotion Period will be considered invalid. Incomplete or incomprehensible entries will be considered invalid. If the winner is not able to provide a proof of purchase, or if the proof of purchase does not comply with all the criteria set out above, the entry will be deemed to be invalid.  
8. If an entrant selected as a winner is found to be in breach of these Terms and Conditions, his/her entry may be considered to be invalid at the sole discretion of the Promoter.
9. Multiple entries by the same entrant are permitted subject to each single entry be submitted separately and in accordance with the entry requirements.

The Prize

10. The prize is HandiTheatre® Outdoor Cinema Package to the value of RRP $3,498 (including GST) consisting of:
HandiTheatre® portable entertainment system from Smart Digital
2.5m diagonal handiscreen, with inflatable movie screen with rechargeable blower
SmartBox with powerful digital projector including the following functionalities:
Samsung BluRay (BD) player 
Digital TV tuner
Auxilary inputs for video, electronic games such as PS3, MP3 audio and computer
Twist stakes & teathers in a deluxe wheel duffel bag
 (the Prize)
11. There are 10 (ten) Prizes to be won to the total value of RRP $34,980.

The draw

12. There is one (1) draw (the Draw) which will take place at 12 noon on Friday  13  April 2012 at Message Media, Level 22, 385 Bourke St, Melbourne, Victoria in accordance with relevant permit authority regulations.
13. The first 10 valid entries drawn will win the Prize.  
14. The Prize winners will be contacted by phone and in writing by means of an email within five (5) working days of the Draw date.
15. The name of the Prize winners will be published in The Australian newspaper on Wednesday 25 April 2012 or earlier following validation of the winning entry by the Promoter. The decision of the Promoter in relation to any aspect of this Promotion is final and binding on any person who enters. No correspondence will be entered into.
16. Subject to the winner been readily identifiable, the Prize will be delivered to the winner’s door within 28 days of the Draw.
17. If, following reasonable efforts, the Prize winner cannot be identified, the Promoter will keep the Prize for the winner until 5 p.m. (AEST) on Thursday, 26th July 2012.
18. If necessary, an unclaimed prize draw will be conducted at 12 noon on Monday, 30 July 2012 at the same place as the original draw, subject to any directions from the regulatory authority. If an unclaimed prize draw is conducted, the winner of that draw will be contacted by phone and by means of email within five (5) days of the unclaimed prize draw taking place. The unclaimed prize draw winner’s name will then be published in The Australian newspaper on Thursday, 2nd of August 2012 or earlier and delivered to the winner’s door within 28 days following the unclaimed prize draw.  
19. The Prize must be taken as offered and no compensation is payable if the winner is not able to use the Prize as offered. The Prize or any part thereof is not exchangeable, transferrable or redeemable for cash or any other goods or services.
20. If the Prize is unavailable, the Promoter, at its sole discretion, reserves the right to substitute the Prize with an alternative Prize of the equal value and/or specification, subject to any written directions from the regulatory authority.
21. Subject to an unclaimed prize draw and the regulatory requirements of the individual state or territory, if the winner does not for any reason take a part or an element of the Prize by the time stipulated by the Promoter, this part or the element of the Prize shall be considered to be forfeited by the winner, and will be dealt with by the Promoter at its sole discretion.
22. The Promoter is not liable for any taxes which may be payable as a consequence of the winner receiving the Prize.

Termination

23. If for any reason this competition does not run for its duration due to a computer virus, tampering, unauthorised intervention, fraud, technical difficulties or failures that corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition or for any other cause beyond the Promoter’s control, the Promoter reserves the right subject to the regulatory requirements in each State or Territory to cancel, terminate, modify or suspend the competition or to disqualify any individual who tampers with the entry or judgment process.

Privacy

24. All personal information submitted by an entrant for the purpose of this Promotion shall be dealt with in accordance with the Privacy Policy of the Promoter. The Promoter’s privacy policy can be viewed at [insert the link to the Privacy Policy ]
25. Subject to the Promoter’s Privacy Policy, by entering into this competition, unless otherwise advised, each entrant agrees that the Promoter may use the entrant’s personal information for future research, promotional, marketing and publicity purposes (including sending the entrant electronic and SMS messages) without any further reference, payment or other compensation to the entrant. 26. By entering into the Promotion each entrant understands and agrees that in the event that they are the winner, the Promoter may, at its sole discretion and without any further notice to the winning entrant, use the entrant’s name, image and likeness (including photograph, filming and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including the outcome) and promoting any products manufactured, distributed and/or supplied by the Promoter or its related companies.
27. By entering into the Promotion each entrant understands and agrees that in the event that they are the winner, the Promoter may require them to participate in news and/or media activities surrounding the Promotion, such as photographic shoots and interviews. The winning entrant hereby aggrees to the participation in such activities for a reasonable period following the Promotion and without any remuneration

Details of liability

28. The Promoter shall not be liable for any direct, indirect or consequential loss, damage or injury suffered or sustained (even if caused by negligence) by an entrant (or a third party), as a result of participating in this Promotion, or accepting and/or using the Prize, except for any liability that cannot be excluded by law.
29. Any costs associated with this Promotion (including access to the Promoter’s website) are the entrant’s responsibility and the Promoter will not be liable for any such costs.
30. The Promoter is not responsible for lost data, interrupted communications and/or any entries not received by the Promoter due to the technical difficulties, network servers problems or other connections, failed computer transmissions or other errors of any kind, whether human, electronic or mechanical.
31. The Prize must be taken as offered. The Promoter is not liable for any damage, defect, deficiency, technical malfunctions or any other defect whatsoever associated with the Prize, and will take no responsibility if the Prize is damaged, delayed or lost in transit.
32. The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as prizes.
33. By entering into this Promotion and therefore accepting these Terms and Conditions, the winner releases the Promoter, its affiliates, its directors, officers, employees and agents, from any and all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way incurred by the winner as a result of any loss or damage to any physical property of the winner, or any injury to or death of any person arising out of, or related to, or in any way connected with the Promoters or the Prize.
34. Nothing in these Terms and Conditions limits, excludes or modifies the statutory consumer guarantees as applicable to this Promotion pursuant to the provisions of the Competition and Consumer Act. Except for any liability that cannot be excluded by law, the Promoter, its affiliates, its directors, officers, employees and agents accept no liability (including in negligence), for any personal injury, any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion.
